Terms of Service

Please read these Terms of Service ("Terms") carefully before using the South Beach Casino Club mobile application ("the App") operated by SOUTH BEACH CASINO CLUB LTD ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and complete

3. Account Registration

3.1 Account Creation

To access certain features of the App, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

3.2 Account Types

The App supports multiple account types:

  • Guest: Browse-only access to discover-oriented content
  • Demo Account: Full hotel features for review and testing purposes
  • Activated User: Full access after hotel front desk activation

4. Use of the App

4.1 Permitted Use

You may use the App solely for its intended purpose as a resort companion and digital pass application. Features include:

  • Accessing your digital room pass
  • Browsing events and making RSVPs
  • Booking spa and dining services
  • Requesting room service and housekeeping
  • Managing your Beach Bucks rewards

4.2 Prohibited Conduct

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to any portion of the App
  • Interfere with or disrupt the App or its servers
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices
  • Share your account credentials with others
  • Use the App to harass, abuse, or harm others

5. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of SOUTH BEACH CASINO CLUB LTD and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

6. Digital Pass and Access

The digital pass feature provides electronic access credentials. You acknowledge that:

  • The digital pass is tied to your registered account
  • Pass format (QR/barcode/both) is controlled via Settings only
  • Physical credentials may still be required in certain situations
  • We reserve the right to revoke digital access for security reasons

7. Service Requests and Bookings

Service requests made through the App (room service, housekeeping, spa bookings) are subject to:

  • Availability and capacity constraints
  • Hotel operating hours and policies
  • Confirmation from hotel staff
  • Applicable fees and charges

8. Beach Bucks Rewards Program

Participation in the Beach Bucks rewards program is subject to additional terms. Points have no cash value and cannot be transferred. We reserve the right to modify or terminate the rewards program at any time.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The App will function uninterrupted, secure, or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • Results from using the App will meet your requirements

10. Limitation of Liability

To the maximum extent permitted by law, SOUTH BEACH CASINO CLUB LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of or inability to use the App.

11. Indemnification

You agree to defend, indemnify, and hold harmless SOUTH BEACH CASINO CLUB LTD and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

You may delete your account at any time through the App's Settings. Demo accounts cannot be deleted.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SOUTH BEACH CASINO CLUB LTD is established, without regard to conflict of law provisions.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be notified through the App. Your continued use of the App after changes constitutes acceptance of the new Terms.
